BetterWeigh App Privacy Policy

This Privacy Policy applies to the use of the BetterWeigh Towing Scale, which includes the product and its mobile application (the “Service”).  The Service is provided by CURT Manufacturing, LLC (“CURT” or “we”).  This Privacy Policy explains what personal information we may collect from you, how we may use it, and the choices you have regarding our use of it.  If you choose to use our Service, you agree to the terms of this Privacy Policy.   

What Categories of Personal Information Does the Service Collect?

We may collect certain information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a consumer or household (“Personal Information”).  Personal Information does not include de-identified or aggregated consumer information. 

  • Identifiers: We may collect certain identifiers, including your Vehicle Identification Number (“VIN”).  We collect this information when you provide it to the Service.  We also may collect your name and other contact information if you provide it to us to register as a user of the Service or to contact us.
  • Network activity information: We may collect information regarding your interaction with the mobile application.  This information may include information about your device, such as:  device identifier, model and device type, name and version of the operating system, mobile carrier, settings and language of the device, the frequency with which you use the application.  We may collect this information in server logs, within the application, and using third party service providers.

How Does the Service Use and Share Your Personal Information?

  • Identifiers: We may use your identifiers to provide you with the Service and to respond to any inquires that you make to us about the Service.  We may share your VIN, along with non-Personal Information about your vehicle necessary to perform the Service, with a third-party service provider for the purpose of storing the data.  
  • Network activity information: We may use your network activity information to research ways to improve the Services or to develop new products and services. 

We take reasonable steps to ensure that companies to whom we share your Personal Information are contractually obligated to keep the Personal Information that we provide to them confidential and to use such information only as we permit.

In addition, where consistent with the laws and regulations of the relevant jurisdiction, we may disclose Personal Information if such disclosure:

  • is needed to respond to subpoenas, court orders, or other legal process or otherwise required by law or the competent governmental or judicial authorities;
  • is needed to cooperate with law enforcement, government or regulatory entities, and safety or investigation authorities;
  • is necessary to establish or preserve a legal claim or defense;
  • is part of a corporate restructuring, sale of assets, merger or divestiture; or
  • is necessary to prevent fraud or other illegal activities, such as willful attacks on our information technology systems.

In the preceding 12 months, we have not sold, and we will not sell, any Personal Information to non-affiliated third parties without your consent.  We also have not and will not sell the Personal Information of minors under 16 years of age to non-affiliated third parties without affirmative consent.

Children’s Privacy

These Services are not directed at, and we do not knowingly collect Personal Information from, anyone under the age of 13. 

Security

We value your trust in providing us your Personal Information and we strive to use commercially reasonably means of protecting it.  But please note that no method of transmission over the internet or method of electronic storage is 100% secure and reliable, and we cannot guarantee its absolute security.

Your Rights

You may have a right to request and receive information about our collection of your Personal Information or to delete Personal Information that we have collected about you.  If you would like to contact us concerning those rights, please utilize the contact information provided below.

Changes to This Privacy Policy
